General terms of the customer agreement for FitPit Oy

1. General customer agreement (hereinafter referred to as the agreement)

By accepting this agreement at the time of booking, the agreement is considered to be made between both parties. The parties to the agreement are the service provider FitPit Oy (hereinafter referred to as the Provider) and the user of the service (hereinafter referred to as the Customer). The Provider and the Customer commit to acting in accordance with the terms of this agreement upon booking.

2. Agreement for instruction and coaching

2.1 Private lessons

The contract for participating in private tutoring is formed in connection with the booking of private lessons. The booking can be made either through the online store or customarily via email.

2.2. Small groups

An agreement for participation in a small group is made at the time of booking the small group. Swimming sessions canceled for reasons beyond our control will be replaced with additional swimming sessions.

2.3. Courses

Includes baby and family swimming sessions, children's swimming schools, children's intensive courses, children's swimming groups, adult swimming courses and swimming schools, adult intensive courses and adult training groups.

An agreement for participation in a course is made at the time of booking the course. Swimming sessions canceled for reasons beyond our control will be replaced with additional swimming sessions.

2.4. Swimming lanes 

An agreement for renting a swimming lane is made at the time of booking the lane. 

2.5. Video course

An agreement for participation in a video course is made at the time of purchasing the video course.

3. Order terms 

When agreeing on or booking services, the Customer agrees to provide the Provider with correct information. By booking private lesson, a small group, a course, a swimming lane or a video course, the Customer agrees to comply with these terms of the agreement. The agreement is binding to the extent that it is further specified in these terms.

4. Terms for termination of the agreement

4.1 Private lessons

The agreed private lesson can be rescheduled to another time at the request of the customer 24 hours before the agreed time. The customer will be charged 50% of the total price for canceling private lesson if there is less than 24 hours before the agreed start time.

The customer will be charged 50% of the total price for canceling private lesson if there is 5-24 hours before the agreed start time. If the customer cancels less than 5 hours before the agreed start of private lesson, no refund will be made.

The agreed private lesson can be canceled by the Provider five (5) hours before the lesson. If the cancellation of a private lesson is due to the Provider, the Provider must offer a new time for the canceled private lesson.

Booked and paid private lesson can only be canceled by the customer with a sick leave certificate.

4.2 Small groups 

Booked and paid small group lesson can be canceled or rescheduled to another time by the customer 14 days before the start of the booked small group. The customer will be charged 50% of the total price for canceling the small group if there is 1-14 days before the start of the small group. If the customer cancels less than 24 hours before the start of the small group, or after the start date, the course fee will not be refunded. The agreed small group can be canceled by the Provider 24 hours before the start if the group does not take place due to a low number of participants. The Provider is obliged to refund the money or give an alternative option for the lost small group.

The customer has the opportunity to make up for one absence from the small group with a separate substitutive session. Other missed sessions will not be compensated. A small group lesson that has already started can be canceled by the customer only with a doctor's certificate.

All cancellations, including those made within the cancellation period, will be charged a handling fee of 15€.

4.3 Courses

The booked and paid course can be postponed to another time at the Customer's initiative 14 days before the start of the booked course. The customer will be charged 50% of the  course cancellation if there is a time of 1-14 days before the start of the course. The  customer's course fee will not be refunded in case of cancellation if there is less than 24 hours before the start time. The agreed course can be canceled at the initiative of the Operator 3 days before the start if the group does not take place. The operator is obliged to return the money or give another alternative to the lost rate. 

The customer has the opportunity to replace one absence with a separate compensation lesson. Other lost times will not be compensated. FitPit Oy determines the dates and locations of compensation lessons. A course that has already begun can only be canceled against a medical certificate. 

All cancellations, including those made within the cancellation period, will be charged a handling fee of 15€.

4.4 Swimming lane rental 

A booked and paid swimming lane rental can be moved to another available time at the request of the customer 7 days before the booked time. The cancellations made between 1-7 days before the rental time will be charged 50% of the total rental cost. The customer's rental fee will not be refunded in the case of cancellation if there is less than 24 hours before the rental start time. A booked swimming lane can be canceled by the operator 2 days before the time. The operator is obliged to refund the money or offer another option for the lost booking.

All cancellations, including those made within the cancellation period, will be charged a handling fee of 15€.

4.5 Renting the Kilo swimming pool

A booked and paid for pool rental can be moved to another available time at the request of the customer 7 days before the booked time. The customer will be charged 50% of the total rental cost for the cancellation if there is 1-7 days before the rental time. The customer's rental fee will not be refunded in the case of cancellation if there is less than 24 hours before the rental start time. A booked pool rental can be cancelled by the operator 2 days before the time. The operator is obliged to refund the money or offer another option for the lost booking.

All cancellations, including those made within the cancellation period, will be charged a handling fee of 15€.

4.6 Video courses

A booked and paid video course can be rescheduled to a different time by the customer's request 14 days before the course start date. In case of cancellation, the consumer protection law's 14 day cancellation right applies.

4.7. Baby and Family swimming sessions (updated February 15, 2024)

A booked and paid course can be rescheduled to another time at the Customer's initiative up to 14 days before the scheduled course start. The Customer will be charged 50% of the course fee if the cancellation occurs 1-14 days before the course start date. No refund of the course fee will be issued if the cancellation occurs less than 24 hours before the start date. An agreed-upon course may be canceled by the Operator three (3) days before the start date if the group does not materialize. The Operator is obligated to refund the money or provide an alternative for the lost course.

The Customer has the opportunity to replace two missed sessions with a separate compensation session. No compensation will be provided for other missed sessions. A started and booked course can only be canceled with a medical certificate. FitPit Oy determines the timing and locations of makeup sessions.

Starting from August 1, 2024, customers will have the opportunity to replace one missed session with a separate compensation lesson. This change applies to baby and family swimming sessions booked after August 1, 2024. Other missed sessions will not be compensated for. For a course that has already begun and been booked, cancellation is only possible with a medical certificate. FitPit Ltd determines the times and locations for makeup sessions.

A processing fee of 15€ will be charged for all cancellations, including cancellations made within the cancellation period.

5. FORCE MAJEURE - Situations and Unforeseeable Obstacles

These terms and conditions do not apply to force majeure situations, unforeseeable obstacles (serious illness, death), long foreign trips, accidents or any other situations that are not caused by the performer or the customer.

Proof of the existence of an unforeseeable obstacle must be provided by an official or other reliable statement established by the parties together. The parties may not invoke an unforeseeable obstacle unless they have immediately notified of it upon receiving the information. Also, notice of the end of the obstacle must be given promptly.

The provider is not obligated to compensate for lost services if private lessons, courses, swimming tracks or exercise classes are canceled for reasons entirely outside of the provider's control, such as swimming pool operators denying access to the pools, hygienic damage in the pool or any other similar obstacle outside of the provider’s control.

6.  Being late from a lesson

If the customer arrives late to the lesson, the lost time will not be compensated.

If the provider arrives late to the instructional session, the lost time will be compensated at a mutually agreed time with the customer.

If the customer does not arrive to the instructional session within 15 minutes of the scheduled start time, the instructional session will be considered canceled by the customer's request.

7. Service Description

7.1 Private lesson Service Description (updated September 19, 2023) 

Private lessons are provided at the agreed location and time as specified during the booking. Private tutoring is based on professional instruction, and all instructors employed by the operator are trained for their role.

7.2 Small Group Service Description

Small groups are organized in designated swimming pools at a mutually agreed upon time. The themes of the courses are pre-announced to the customer. There are 2-3 people in a small group. The instructors of the small groups are trained for their work.

7.3 Swimming Course Service Description

Swimming courses are organized in designated swimming pools at a mutually agreed time. The themes of the courses are pre-announced to the customer. The instructors of the swimming courses are trained for their work.

7.4 Lane Rental Service Description (updated January 26, 2023)

Lane rental is organized in designated swimming pools at a mutually agreed time. The lane rental covers one lane for the customer's use and one lane rental fee includes 1-7 people/lane/rental. There will be a life guard organized by the provider during the lane rental period.

7.5 Video Courses Service Description

The instructional materials for the video course will be sent in the provider's designated app at the mutually agreed time.

All materials sent by the provider are intended for private use only. The content is protected by intellectual property rights and copying or using the content without written consent from FitPit Oy is prohibited.

8.  Safety Rules (updated October 29, 2021)

All services take place under the responsibility of the customer. The customer is responsible for their own health in a manner that does not pose a health risk. The customer must not practice under the influence of alcohol, drugs, or prohibited doping substances. The provider has the right to refuse to provide services to the customer if it is apparent that the customer is violating the safety rules outlined in this agreement.

Customers who are of legal age are not insured by the provider. Customers under the age of 18 are covered by accident insurance on behalf of the provider.

8.1. Video Courses

Each participant performs the exercises and movements instructed in the training at their own risk, and under the responsibility of the legal guardian if under 18. The service provider is not responsible for any injuries, illnesses or accidents that may occur to the participants. FitPit Oy is not liable for any direct or indirect damages that may have resulted from the training.

9. Payment Methods

Through the online store, Paytrail's payment methods are available (online bank payments: Nordea, Osuuspankki, Danske Bank, Aktia, Säästöpankki, and S-pankki; Credit cards: Visa and MasterCard). The operator reserves the right to not accept cash or sports vouchers.

We accept the following payment methods for sports vouchers: SmartumPay, Edenred, ePassi, Virike vouchers and Smartum Liikunta and Liikunta and Culture vouchers.

10. Payment terms (updated September 19, 2023)

The up-to-date price lists for private lessons, small groups and swimming courses can be found on the service's website (www.fitpit.fi). The Customer is obligated to review the price list before placing an order. The service fee is paid at the time of booking and is determined based on the price list in effect on the date of the order. All prices include value-added tax.

For customized private tutoring, the Customer will receive an invoice via email before the first teaching session. The invoice must be paid by the due date or before the first swimming session. The Operator reserves the right to refuse to provide the agreed-upon service if the invoice has not been paid. If the Customer wishes to pay for customized private tutoring in installments, a separate 15€ invoicing fee will be charged with each invoice.

The Customer is responsible for paying any applicable entrance fees to their chosen swimming facility.

The due date of the invoice is before the first lesson or at most two weeks after the order. All complaints about the invoice must be made before the due date.

The late payment interest is 8%. The reminder fee is 5.00 € per reminder invoice. The payment reminder will be sent 14 days after the invoice due date. If the payment reminder is not paid by the due date, the invoice will be handed over to collection. The payment term for the payment reminder is 14 days.

The provider reserves the right to change prices without separate notice.

11. Other terms

The customer agreement only includes the teaching services. The customer is obligated to pay for their own any other possible costs, such as rental for space and equipment, and travel expenses.

12. Customer register and data protection

The processing and registration of the company's customer information is done in accordance with the Personal Data Act (22.4.1999/523). By signing the customer agreement, the customer agrees to receive direct marketing mail from the supplier, meaning the supplier can send notifications and direct marketing mail to the customer about their products and services. However, the customer can at any time inform the supplier of their desire to limit or revoke their consent.

13. Finnish law 

In case of disputes, Finnish law will be applied.
