FitPit Oy Terms and Conditions effective as of 14 March 2026
These terms and conditions apply to the services and products offered by FitPit Oy, unless otherwise stated for a specific service or product.
By accepting these terms in connection with a booking, purchase, or registration, the customer agrees to comply with them.
1. General
The provider of FitPit Oy’s services is FitPit Oy (Business ID 2700454-5).
An agreement between the customer and FitPit Oy is formed when the customer makes a booking, purchase, or registration and pays for the service or commits to paying for it in a manner accepted by FitPit Oy.
FitPit Oy has the right to update these terms and conditions. The new terms apply to bookings, purchases, and agreements made after the new terms enter into force, unless otherwise provided in these terms or by mandatory legislation.
As a rule, purchases already made are governed by the terms in force at the time of purchase. However, FitPit Oy may make changes to service delivery and practical operating methods, provided that such changes do not weaken the customer’s rights under mandatory legislation.
2. Services and formation of the agreement
2.1 Private lessons
An agreement for private lessons is formed when the customer makes a booking via the online store, by email, via a form, or in another manner accepted by FitPit Oy, and pays for the service or commits to paying for it in a manner accepted by FitPit Oy.
2.2 Small groups
An agreement for a small group is formed when the customer makes a booking and pays for the service or commits to paying for it in a manner accepted by FitPit Oy.
2.3 Courses
Courses may include, for example, baby and family swimming, children’s swimming schools, children’s intensive courses, children’s swim groups, adult swimming courses, adult swimming schools, adult intensive courses, adult training groups, and other course-based services provided by FitPit Oy.
An agreement for a course is formed when the customer makes a booking and pays for the service or commits to paying for it in a manner accepted by FitPit Oy.
2.4 Baby and family swimming
The same terms as for courses apply to baby and family swimming, unless otherwise stated in this agreement or in the service description.
2.5 Lane and pool rental
An agreement for the rental of a swimming lane or pool is formed when the customer makes a booking and pays for the service or commits to paying for it in a manner accepted by FitPit Oy.
2.6 Water aerobics
An agreement for participation in water aerobics is formed when the customer makes a booking and pays for the service or commits to paying for it in a manner accepted by FitPit Oy.
2.7 Events and swimming events
Events may include, for example, a 10 km swim, technique clinics, individual swimming events, children’s swimming birthday parties, competitions, women’s swimming sessions, or other events organized by FitPit Oy.
An agreement for participation in an event is formed when the customer registers for the event and pays the participation fee or commits to paying it in a manner accepted by FitPit Oy.
2.8 Video courses and other digital content
An agreement for a video course or other digital content is formed at the time of purchase.
2.9 Gift cards
An agreement for the purchase of a gift card is formed at the time the gift card is purchased.
3. Customer information and responsibility
The customer is responsible for ensuring that the information provided to FitPit Oy is correct, up to date, and sufficient for delivering the service. In the case of a minor participant, the agreement must be entered into by a guardian or another person entitled to make a booking on behalf of the minor.
The person making the booking is responsible for ensuring that the participant’s state of health, skill level, and other information relevant to participation have been provided correctly.
FitPit Oy uses electronic booking and customer management systems. The customer is responsible for ensuring that their contact details, booking information, and billing details are correct.
4. FitPit Oy’s right to make changes
FitPit Oy has the right to make reasonable changes to the provision of the service, provided that such changes do not materially alter the content of the service.
Such changes may include, for example:
a change of instructor
a change of teaching venue
a minor schedule change
a change of venue to another pool facility operated or used by FitPit Oy
combining a group with another group assessed to be of a similar level
changing the way an event is carried out for safety or operational reasons
FitPit Oy has the right to cancel or postpone a service if there is a justified reason for doing so, such as too few participants, a safety reason, instructor unavailability, a hygiene incident, a technical fault, an official order, or another operational obstacle.
In such a situation, FitPit Oy has the right primarily to:
offer a new date and time
offer a corresponding service or the closest equivalent service
provide a replacement session or other right of use, if permitted under these terms for the specific service
refund only the part of the service that was not delivered
FitPit Oy is not obliged to refund the full payment if the main content of the service has been delivered or the customer is offered a reasonable alternative performance.
5. Cancellations, rescheduling, and absences
5.1 Private lessons
A private lesson may be rescheduled at the customer’s initiative no later than 24 hours before the agreed start time.
If cancellation is made 5–24 hours before the agreed start time, FitPit Oy has the right to charge 50% of the private lesson price.
If cancellation is made less than 5 hours before the agreed start time, the customer fails to attend, or cancellation is made after the lesson has started, no payment will be refunded.
A private lesson already paid for may be rescheduled or otherwise exceptionally handled at the customer’s initiative only if the customer provides FitPit Oy with reliable evidence of a prolonged illness or another serious impediment. FitPit Oy will assess the matter case by case.
If FitPit Oy cancels a private lesson, FitPit Oy will primarily offer a new appointment. If offering a new appointment is not reasonably possible, FitPit Oy may refund the portion of the lesson that was not delivered.
The course replacement session system does not apply to private lessons.
5.2 Small groups
A booked and paid small group may be cancelled or rescheduled at the customer’s initiative no later than 14 days before the start of the small group.
If cancellation is made 1–14 days before the start of the small group, FitPit Oy has the right to charge 50% of the price of the small group.
If cancellation is made less than 24 hours before the start of the small group, the customer fails to attend, or cancellation is made after the small group has started, no payment will be refunded.
A small group that has already started cannot be cancelled, interrupted, rescheduled, or refunded unless FitPit Oy states otherwise in writing.
Absences and individual small group sessions cancelled by FitPit Oy are subject to the replacement session system described in section 6.
5.3 Courses
A booked and paid course may be cancelled or rescheduled at the customer’s initiative no later than 14 days before the start of the course.
If cancellation is made 1–14 days before the start of the course, FitPit Oy has the right to charge 50% of the course price.
If cancellation is made less than 24 hours before the start of the course, the customer fails to attend, or cancellation is made after the course has started, no payment will be refunded.
A course that has already started cannot be cancelled, interrupted, rescheduled, or refunded unless FitPit Oy states otherwise in writing.
Absences and individual course sessions cancelled by FitPit Oy are subject to the replacement session system described in section 6.
5.4 Baby and family swimming
The cancellation, rescheduling, absence, and replacement practices for baby and family swimming are the same as for courses.
5.5 Lane rental
A booked and paid lane rental may be rescheduled to another available time at the customer’s initiative no later than 7 days before the start of the booking.
If cancellation is made 1–7 days before the start of the booking, FitPit Oy has the right to charge 50% of the lane rental price.
If cancellation is made less than 24 hours before the start of the booking, the customer fails to attend, or cancellation is made after the booking has started, no payment will be refunded.
If FitPit Oy cancels a lane rental, FitPit Oy will primarily offer a new date and time or a corresponding service. If this is not reasonably possible, FitPit Oy may refund the part that was not delivered.
The replacement session system does not apply to lane rentals.
5.6 Pool rental
A booked and paid pool rental may be rescheduled to another available time at the customer’s initiative no later than 7 days before the start of the booking.
If cancellation is made 1–7 days before the start of the booking, FitPit Oy has the right to charge 50% of the pool rental price.
If cancellation is made less than 24 hours before the start of the booking, the customer fails to attend, or cancellation is made after the booking has started, no payment will be refunded.
If FitPit Oy cancels a pool rental, FitPit Oy will primarily offer a new date and time or a corresponding service. If this is not reasonably possible, FitPit Oy may refund the part that was not delivered.
The replacement session system does not apply to pool rentals.
5.7 Water aerobics
A booked and paid water aerobics session may be cancelled or rescheduled at the customer’s initiative no later than 24 hours before the start of the class.
If cancellation is made less than 24 hours before the start of the class, or the customer fails to attend, no payment will be refunded.
If FitPit Oy cancels a water aerobics session, FitPit Oy may offer a new date and time, a replacement service, or refund the part that was not delivered.
The course replacement session system does not apply to water aerobics unless otherwise stated for the specific service.
5.8 Events and swimming events
Registration for an event is binding.
If the customer cancels their participation or fails to attend the event, the participation fee will not be refunded unless otherwise provided for the specific service or required by mandatory legislation.
If FitPit Oy cancels an event before it begins, FitPit Oy will primarily offer a new date and time, a corresponding event, or refund the participation fee for the part not delivered.
If an event must be changed due to safety, weather, official requirements, or other similar reasons, FitPit Oy has the right to make the necessary changes to the event without an obligation to refund the full participation fee, provided that the main content of the event can still be carried out.
The replacement session system does not apply to events.
5.9 Video courses and digital content
In distance sales, a consumer customer generally has a 14-day right of cancellation from the date of the agreement for the purchase of a video course or other digital content, unless delivery of the digital content has begun with the customer’s express prior consent and the customer has at the same time acknowledged losing their right of cancellation.
Once delivery of the digital content has begun with the customer’s consent, no payment will be refunded.
The right to use a video course or other digital content is personal and may not be transferred to another person without the prior written consent of FitPit Oy.
5.10 Gift cards
A gift card is valid for the period stated on the gift card. Unless otherwise stated, the gift card is valid for 6 months from the date of purchase.
A gift card cannot be exchanged for cash, and no cash refund will be paid.
If the value of the gift card does not cover the full price of the service, the customer must pay the difference.
If the price of the service is lower than the value of the gift card, the unused portion will not be refunded in cash or credited to the customer account unless FitPit Oy states otherwise in writing.
Lost, stolen, or expired gift cards will not be replaced.
6. Replacement session system for courses, small groups, and baby and family swimming
This replacement session system applies to small groups, courses, and baby and family swimming unless otherwise stated for the specific service.
The customer is entitled to a maximum of one replacement session per course or small group.
A replacement session is not a cash refund, price reduction, balance credit, customer account credit, or transferable benefit. A replacement session means the right to book one individual swimming session designated by FitPit Oy in accordance with these terms.
The replacement session is implemented using a single-use code. The code is delivered to the customer once the customer completes the form designated by FitPit Oy or follows the instructions of FitPit Oy customer service.
The code must be used to make a booking within 14 days from the date the code is delivered. If no booking is made within this period, the right to the replacement session expires.
The replacement session may only be used for individual swimming sessions separately designated by FitPit Oy and only in pool facilities operated or designated by FitPit Oy. FitPit Oy decides the times, locations, capacity, booking channel, and other terms of use for replacement sessions.
A replacement session is personal, single-use, and cannot be exchanged for cash, transferred to another person, transferred to another course, or combined with other benefits.
If the customer cancels a replacement session, fails to attend, or is late to such an extent that participation is no longer practically possible, the replacement session is deemed used and no new replacement session will be granted.
In case of illness, the waiting period is 14 days. No compensation other than a possible replacement session under this section will be granted for illness-related absences lasting less than 14 days.
If continuous inability to participate due to illness lasts for more than 14 days, the customer may request case-by-case consideration by providing FitPit Oy with reliable evidence without delay. FitPit Oy will assess case by case whether additional compensation, rescheduling, or another exception will be granted.
If FitPit Oy cancels an individual teaching session, for example due to instructor illness, unavailability of the pool facility, a hygiene incident, a technical fault, or another similar reason, FitPit Oy may at its discretion arrange a replacement teaching session or provide the customer with a single-use code for booking one individual swimming session.
FitPit Oy does not guarantee that an individual swimming session offered as a replacement session corresponds to the original group, teacher, level, schedule, location, or teaching content.
For purchases made on or after 14 March 2026, no balance credits, customer account credits, or other forms of monetary-equivalent compensation will be granted for absences or individual course sessions. Any possible compensation will be provided solely as a replacement session in accordance with this section.
A replacement session is deemed to fulfil FitPit Oy’s compensatory obligation for the relevant missed or cancelled session.
7. Late arrival and failure to attend
If the customer is late, the lost time will not be compensated and the lesson, session, or other service will not be extended.
FitPit Oy has the right to deny participation if the customer arrives so late that participation endangers safety, disturbs instruction, or is no longer practically possible.
If the customer does not arrive within 15 minutes of the start of the service and no other arrangement has been agreed, FitPit Oy has the right to consider the service cancelled by the customer.
8. Pool facility unavailability and force majeure
FitPit Oy is not liable for delay, cancellation, postponement, interruption, or alteration of the service if the reason is an obstacle beyond FitPit Oy’s control that FitPit Oy could not reasonably have foreseen or avoided.
Such situations may include, for example:
an official order
an epidemic or pandemic
fire
water damage
a hygiene incident
an exception related to water quality
a technical fault
industrial action
an electricity or telecommunications disruption
prohibition on using the pool facility
a decision by the property owner or operator
safety reasons
another similar reason
If the pool facility is unavailable, FitPit Oy has the right to arrange a replacement date and time, offer another reasonable alternative, or refund only the part that was not delivered in accordance with the service-specific terms.
FitPit Oy is not liable for any indirect losses or costs incurred by the customer in such situations.
9. Safety, conduct, and state of health
The customer participates in the service at their own risk and is responsible for ensuring that their own or the minor participant’s state of health is suitable for participation in the service.
The customer may not participate in the service under the influence of alcohol, narcotics, or other substances that impair functional ability.
FitPit Oy has the right to prevent participation or interrupt participation if this is necessary for reasons of safety, health, disruptive behaviour, hygiene, intoxication, or failure to follow instructions.
FitPit Oy also has the right to interrupt the customer’s or participant’s participation in the service if the participant endangers safety, disrupts instruction or the event, fails to follow the instructor’s or staff’s instructions, or otherwise behaves in an inappropriate or disruptive manner.
In such a case, no payment will be refunded.
10. Customer property
FitPit Oy is not responsible for the loss, damage, or theft of the personal property of the customer, participant, or guardian in changing rooms, pool facilities, or other premises related to the use of the service.
The customer is responsible for safeguarding their own property.
11. Prices, payments, and debt collection
The price of a service or product is determined according to the price list in force at the time of purchase.
FitPit Oy has the right to change prices for future purchases without prior notice. Changes do not apply to bookings that have already been confirmed and paid for, unless there is an obvious pricing, input, or technical error.
If an invoice is overdue, FitPit Oy has the right to charge statutory default interest, a payment reminder fee, and reasonable collection costs.
For purchases made through the online store, the payment methods offered are those provided by Paytrail (online bank payments: Nordea, Osuuspankki, Danske Bank, Aktia, Savings Bank, and S-Bank; credit cards: Visa and MasterCard).
For employee exercise benefits, we accept the following payment methods: SmartumPay, Edenred, ePassi, Virike vouchers, and Smartum Exercise. The operator reserves the right not to accept cash payments or exercise vouchers.
12. Data protection
FitPit Oy processes personal data in accordance with the applicable data protection legislation in force from time to time. More detailed information on the processing of personal data is available in FitPit Oy’s privacy policy.
13. Intellectual property rights
All material provided by FitPit Oy, such as video courses, teaching materials, recordings, exercise instructions, texts, images, and other content, is the property of FitPit Oy or its partners, or is used under licence.
The material is intended solely for the customer’s personal use. Copying, distributing, storing, publishing, reselling, or otherwise using the content without the prior written consent of FitPit Oy is prohibited.
14. Limitation of liability
FitPit Oy is liable for the provision of the service in accordance with the mandatory laws of Finland.
FitPit Oy is not liable for indirect damages or costs, such as loss of income, travel costs, accommodation costs, parking costs, or other indirect expenses.
Any liability for damages on the part of FitPit Oy is always limited to no more than the amount paid by the customer for the relevant service, unless otherwise required by mandatory legislation.
15. Applicable law and dispute resolution
These terms are governed by Finnish law.
A consumer customer may first submit a dispute to FitPit Oy customer service for consideration. Thereafter, the consumer may contact consumer advisory services and refer the matter to the Consumer Disputes Board. The consumer also has the right to bring the matter before a competent court in accordance with mandatory legislation.
16. Transitional provisions
The new replacement session system applies to purchases of small groups, courses, and baby and family swimming made on or after 14 March 2026.
For purchases made on or after 14 March 2026, no balance credits, customer account credits, or other forms of monetary-equivalent compensation will be granted for absences, individual course sessions, water aerobics, lane rentals, pool rentals, video courses, or other services referred to in this agreement, unless otherwise provided in these terms or required by mandatory legislation.
General terms of the customer agreement for FitPit Oy (for services that has been bought before 13.3.2026)
1. General customer agreement (hereinafter referred to as the agreement)
By accepting this agreement at the time of booking, the agreement is considered to be made between both parties. The parties to the agreement are the service provider FitPit Oy (hereinafter referred to as the Provider) and the user of the service (hereinafter referred to as the Customer). The Provider and the Customer commit to acting in accordance with the terms of this agreement upon booking.
2. Agreement for instruction and coaching
2.1 Private lessons
The contract for participating in private tutoring is formed in connection with the booking of private lessons. The booking can be made either through the online store or customarily via email.
2.2. Small groups
The agreement for participation in a small group is made at the time of booking the small group. Swimming sessions canceled for reasons beyond our control will be replaced with additional swimming sessions.
2.3. Courses
Includes baby and family swimming sessions, children's swimming schools, children's intensive courses, children's swimming groups, adult swimming courses and swimming schools, adult intensive courses and adult training groups.
The agreement for participation in a course is made at the time of booking the course. Swimming sessions canceled for reasons beyond our control will be replaced with additional swimming sessions.
2.4. Lane and pool rental
The agreement for renting a lane or the pool is formed at the time of booking.
2.5. Video course
The agreement for participation in a video course is made at the time of purchasing the video course.
3. Order terms
When agreeing on services or making a booking, the Customer commits to providing accurate information to the Operator. By booking private lessons, small groups, courses, swim lanes, pools, or video courses, the Customer agrees to comply with these terms and conditions. The agreement is binding to the extent specified in these terms.
4. Terms for termination of the agreement
4.1 Private lessons
The agreed private lesson can be rescheduled to another time at the request of the customer 24 hours before the agreed time. The customer will be charged 50% of the total price for canceling private lesson if there is less than 24 hours before the agreed start time.
The customer will be charged 50% of the total price for canceling private lesson if there is 5-24 hours before the agreed start time. If the customer cancels less than 5 hours before the agreed start of private lesson, no refund will be made.
The agreed private lesson can be canceled by the Provider five (5) hours before the lesson. If the cancellation of a private lesson is due to the Provider, the Provider must offer a new time for the canceled private lesson.
Booked and paid private lesson can only be canceled by the customer with a sick leave certificate.
4.2 Small groups
Booked and paid small group lesson can be canceled or rescheduled to another time by the customer 14 days before the start of the booked small group. The customer will be charged 50% of the total price for canceling the small group if there is 1-14 days before the start of the small group. If the customer cancels less than 24 hours before the start of the small group, or after the start date, the course fee will not be refunded. The agreed small group can be canceled by the Provider 24 hours before the start if the group does not take place due to a low number of participants. The Provider is obliged to refund the money or give an alternative option for the lost small group.
The customer has the opportunity to make up for one absence from the small group with a separate substitutive session. Other missed sessions will not be compensated. A small group lesson that has already started can be canceled by the customer only with a doctor's certificate.
All cancellations, including those made within the cancellation period, will be charged a handling fee of 15€.
4.3 Courses
The booked and paid course can be postponed to another time at the Customer's initiative 14 days before the start of the booked course. The customer will be charged 50% of the course cancellation if there is a time of 1-14 days before the start of the course. The customer's course fee will not be refunded in case of cancellation if there is less than 24 hours before the start time. The agreed course can be canceled at the initiative of the Operator 3 days before the start if the group does not take place. The operator is obliged to return the money or give another alternative to the lost rate.
The customer has the opportunity to replace one absence with a separate compensation lesson. Other lost times will not be compensated. FitPit Oy determines the dates and locations of compensation lessons. A course that has already begun can only be canceled against a medical certificate.
All cancellations, including those made within the cancellation period, will be charged a handling fee of 15€.
4.4 Swimming lane rental
A booked and paid swimming lane rental can be moved to another available time at the request of the customer 7 days before the booked time. The cancellations made between 1-7 days before the rental time will be charged 50% of the total rental cost. The customer's rental fee will not be refunded in the case of cancellation if there is less than 24 hours before the rental start time. A booked swimming lane can be canceled by the operator 2 days before the time. The operator is obliged to refund the money or offer another option for the lost booking.
All cancellations, including those made within the cancellation period, will be charged a handling fee of 15€.
4.5 Pool rental
A booked and paid for pool rental can be moved to another available time at the request of the customer 7 days before the booked time. The customer will be charged 50% of the total rental cost for the cancellation if there is 1-7 days before the rental time. The customer's rental fee will not be refunded in the case of cancellation if there is less than 24 hours before the rental start time. A booked pool rental can be cancelled by the operator 2 days before the time. The operator is obliged to refund the money or offer another option for the lost booking.
All cancellations, including those made within the cancellation period, will be charged a handling fee of 15€.
4.6 Video courses
A booked and paid video course can be rescheduled to a different time by the customer's request 14 days before the course start date. In case of cancellation, the consumer protection law's 14 day cancellation right applies.
4.7. Baby and Family swimming sessions
A booked and paid course can be rescheduled to another time at the Customer's initiative up to 14 days before the scheduled course start. The Customer will be charged 50% of the course fee if the cancellation occurs 1-14 days before the course start date. No refund of the course fee will be issued if the cancellation occurs less than 24 hours before the start date. An agreed-upon course may be canceled by the Operator three (3) days before the start date if the group does not materialize. The Operator is obligated to refund the money or provide an alternative for the lost course.
The Customer has the opportunity to replace two missed sessions with a separate compensation session. No compensation will be provided for other missed sessions. A started and booked course can only be canceled with a medical certificate. FitPit Oy determines the timing and locations of makeup sessions.
Starting from August 1, 2024, customers will have the opportunity to replace one missed session with a separate compensation lesson. This change applies to baby and family swimming sessions starting after August 1, 2024. Other missed sessions will not be compensated for. For a course that has already begun and been booked, cancellation is only possible with a medical certificate. FitPit Ltd determines the times and locations for makeup sessions.
A processing fee of 15€ will be charged for all cancellations, including cancellations made within the cancellation period.
5. FORCE MAJEURE - Situations and Unforeseeable Obstacles
These terms and conditions do not apply to force majeure situations, unforeseeable obstacles (serious illness, death), long foreign trips, accidents or any other situations that are not caused by the performer or the customer.
Proof of the existence of an unforeseeable obstacle must be provided by an official or other reliable statement established by the parties together. The parties may not invoke an unforeseeable obstacle unless they have immediately notified of it upon receiving the information. Also, notice of the end of the obstacle must be given promptly.
The provider is not obligated to compensate for lost services if private lessons, courses, swimming tracks or exercise classes are canceled for reasons entirely outside of the provider's control, such as swimming pool operators denying access to the pools, hygienic damage in the pool or any other similar obstacle outside of the provider’s control.
6. Being late from a lesson
If the customer arrives late to the lesson, the lost time will not be compensated.
If the provider arrives late to the instructional session, the lost time will be compensated at a mutually agreed time with the customer.
If the customer does not arrive to the instructional session within 15 minutes of the scheduled start time, the instructional session will be considered canceled by the customer's request.
7. Service Description
7.1 Private lesson Service Description
Private lessons are provided at the agreed location and time as specified during the booking. Private tutoring is based on professional instruction, and all instructors employed by the operator are trained for their role.
7.2 Small Group Service Description
Small groups are organized in designated swimming pools at a mutually agreed upon time. The themes of the courses are pre-announced to the customer. There are 2-3 people in a small group. The instructors of the small groups are trained for their work.
7.3 Swimming Course Service Description
Swimming courses are organized in designated swimming pools at a mutually agreed time. The themes of the courses are pre-announced to the customer. The instructors of the swimming courses are trained for their work.
7.4 Lane Rental Service Description
Lane rental is organized in designated swimming pools at a mutually agreed time. The lane rental covers one lane for the customer's use. There will be a life guard organized by the provider during the lane rental period. At Kilo swimming hall, the booking fee covers 1–7 people per reservation. At Valkea Talo, the booking fee covers 1–6 people per reservation.
7.5 Pool Rental Service Description
Pool rentals are organized at designated swimming halls at the scheduled time. The rental grants the customer exclusive use of the designated pool at the facility. The booking fee covers 1–10 people per reservation. Lifeguard supervision is provided by the operator during the reservation.
7.6 Video Courses Service Description
The instructional materials for the video course will be sent in the provider's designated app at the mutually agreed time.
All materials sent by the provider are intended for private use only. The content is protected by intellectual property rights and copying or using the content without written consent from FitPit Oy is prohibited.
8. Safety Rules
All services take place under the responsibility of the customer. The customer is responsible for their own health in a manner that does not pose a health risk. The customer must not practice under the influence of alcohol, drugs, or prohibited doping substances. The provider has the right to refuse to provide services to the customer if it is apparent that the customer is violating the safety rules outlined in this agreement.
Customers who are of legal age are not insured by the provider. Customers under the age of 18 are covered by accident insurance on behalf of the provider.
8.1. Video Courses
Each participant performs the exercises and movements instructed in the training at their own risk, and under the responsibility of the legal guardian if under 18. The service provider is not responsible for any injuries, illnesses or accidents that may occur to the participants. FitPit Oy is not liable for any direct or indirect damages that may have resulted from the training.
9. Payment Methods
For purchases made through the webshop, the following Paytrail payment methods are available: online bank payments (Nordea, OP/Osuuspankki, Danske Bank, Aktia, Säästöpankki, and S-Pankki) and credit cards (Visa and MasterCard).
The following sports benefit payment methods are accepted: SmartumPay, Edenred, ePassi, Virike vouchers, Smartum Liikunta, and Liikunta & Kulttuuri vouchers. The operator reserves the right to refuse cash or sports voucher payments.
10. Payment terms (updated September 19, 2023)
The up-to-date price lists for private lessons, small groups and swimming courses can be found on the service's website (www.fitpit.fi). The Customer is obligated to review the price list before placing an order. The service fee is paid at the time of booking and is determined based on the price list in effect on the date of the order. All prices include value-added tax.
For customized private tutoring, the Customer will receive an invoice via email before the first teaching session. The invoice must be paid by the due date or before the first swimming session. The Operator reserves the right to refuse to provide the agreed-upon service if the invoice has not been paid. If the Customer wishes to pay for customized private tutoring in installments, a separate 15€ invoicing fee will be charged with each invoice.
The Customer is responsible for paying any applicable entrance fees to their chosen swimming facility.
The due date of the invoice is before the first lesson or at most two weeks after the order. All complaints about the invoice must be made before the due date.
The late payment interest is 8%. The reminder fee is 5.00 € per reminder invoice. The payment reminder will be sent 14 days after the invoice due date. If the payment reminder is not paid by the due date, the invoice will be handed over to collection. The payment term for the payment reminder is 14 days.
The provider reserves the right to change prices without separate notice.
11. Other terms
The customer agreement only includes the teaching services. The customer is obligated to pay for their own any other possible costs, such as rental for space and equipment, and travel expenses.
12. Customer register and data protection
The processing and registration of the company's customer information is done in accordance with the Personal Data Act (22.4.1999/523). By signing the customer agreement, the customer agrees to receive direct marketing mail from the supplier, meaning the supplier can send notifications and direct marketing mail to the customer about their products and services. However, the customer can at any time inform the supplier of their desire to limit or revoke their consent.
13. Finnish law
In case of disputes, Finnish law will be applied.
